1. Acceptance of Terms

By accessing or using Kreator.ai, our website, or any related products and services (including our newsletters), you agree to these Terms of Service and our Privacy practices. If you don't agree, do not use the platform.

You must be at least 18 years old to use Kreator.ai.

When you use Kreator, you're entering into a legal agreement with us. Read it carefully. If you're under 18, this platform isn't for you.

2. Description of Services

Kreator.ai is an AI-powered creative platform that lets you generate marketing materials such as videos, images, scripts, storyboards, and related assets. Users may upload logos, product photos, or other files to generate outputs.

We may host, process, and deliver media on your behalf, integrate with third-party APIs, and provide access to downloadable or shareable content.

Kreator also operates newsletters like Kreator Katalyst, which deliver insights and updates to subscribers.

What this means for you:

You're using a creative AI system that helps you build marketing assets. Some tools rely on third-party services, so performance may depend on them.

3. User Accounts and Access

You may need an account to use some features. You're responsible for keeping your credentials secure and for all actions taken under your account.

We can suspend or terminate your account at our discretion if we believe it violates these Terms.

What this means for you:

Protect your login. If someone misuses your account, you're still responsible for what happens inside it. We can suspend accounts that break the rules.

4. User Content and Ownership

You retain ownership of your uploaded files (logos, photos, audio, video, etc.) and the AI-generated outputs created through your account, except when you voluntarily share content for community use.

By uploading materials, you grant Kreator a limited license to host, process, and display them only as needed to provide the service. We will not use your assets or outputs for marketing, training, or case studies without your explicit permission.

What this means for you:

Everything you create belongs to you. We just need permission to process it while you use the platform. If you choose to share assets publicly, you're giving permission for that content to appear in shared spaces.

5. AI Output Disclaimer

Kreator uses artificial intelligence to generate outputs. These outputs may contain errors, omissions, or content that doesn't fit your intended use. Kreator makes no guarantees about accuracy, originality, or suitability for any purpose.

You are fully responsible for reviewing, editing, and approving all outputs before using them commercially or publicly. Kreator disclaims all liability arising from your use of generated content.

What this means for you:

Treat AI outputs like drafts, not final work. Double-check everything before publishing. You're responsible for what you create with it.

6. Payments, Renewals, and Refunds

Kreator offers recurring monthly and annual subscriptions. We may also offer credit-based on-demand services.

All payments are billed in advance. Subscriptions renew automatically unless cancelled before the next billing cycle. All sales are final — there are no refunds.

We may occasionally offer free trials or beta programs, which can be cancelled anytime before renewal.

What this means for you:

You pay upfront for your plan. It renews automatically unless you cancel. We don't offer refunds, so choose your plan carefully.

7. Prohibited Conduct

You agree not to:

  • Use Kreator to create or distribute illegal, defamatory, violent, pornographic, or discriminatory content.
  • Upload materials that infringe on another party's intellectual property rights.
  • Mislead, harass, or impersonate others.
  • Interfere with, scrape, or reverse-engineer the service.
  • Use outputs for misinformation or harmful purposes.
  • Resell or redistribute the service or its outputs without written permission.

What this means for you:

Be responsible. Don't use Kreator for anything shady, hateful, or illegal. If you do, your account will be terminated.

8. Account Suspension and Termination

We may suspend or terminate accounts at any time, for any reason, including suspected violations of these Terms.

Upon cancellation, you will retain access to your generated assets for 90 days. After that, data may be deleted permanently.

What this means for you:

If your account is closed, you can still download your work for 90 days. After that, we clean up our servers.

9. Privacy and Data Use

We collect and process limited personal information to operate and improve Kreator.ai, including analytics and communications.

We use tools such as Google Analytics and similar technologies. By using our services, you consent to this data processing.

We will publish a separate Privacy Policy once finalized; until then, these Terms govern our data practices.

What this means for you:

We use analytics tools to understand how people use Kreator. We don't sell your data, and we'll post a full Privacy Policy soon.

10. Third-Party Services

Kreator integrates with third-party APIs and services (such as AI model providers and hosting partners). We don't control their performance, availability, or data handling.

Using Kreator means you accept the risk that those services may change, fail, or affect your outputs.

What this means for you:

Some parts of Kreator depend on outside tools. If they go down or change, it might affect your experience — that's out of our hands.

11. Intellectual Property

All software, branding, interfaces, and documentation on Kreator.ai are owned by Kreator, Inc. or its licensors.

Using the service doesn't grant you rights to our technology, models, or brand assets. You may not copy, modify, or distribute our materials without consent.

What this means for you:

You own your creations, but not the Kreator engine that makes them possible. Don't copy or reuse our code, branding, or designs.

12. Community Features and Shared Assets

If you contribute assets, templates, or prompts for community use, you grant Kreator and other users a worldwide, royalty-free license to use, display, and adapt those shared assets.

Kreator may moderate, remove, or highlight community contributions at its discretion.

What this means for you:

When you share something with the community, you're letting others use it too. You can always choose to keep your projects private.

13. Newsletter Subscription

By subscribing to Kreator newsletters (like Kreator Katalyst), you consent to receive email communications from us.

All newsletter content is for informational and educational purposes only — it's not marketing, investment, or legal advice.

You can unsubscribe anytime via the link in each email.

What this means for you:

Our newsletters share insights and updates, not advice. You can leave the list whenever you want.

14. Limitation of Liability

To the maximum extent allowed by law, Kreator, Inc. and its affiliates, officers, and employees are not liable for indirect, incidental, or consequential damages, including lost profits, revenue, or data.

Our total liability for any claim under these Terms will not exceed the amount you paid us in the past 12 months.

What this means for you:

We'll do our best to deliver a great product, but we're not responsible for lost business or damages beyond your subscription fees.

15. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Delaware, excluding conflict-of-law principles.

Any disputes will be resolved through binding arbitration in Delaware, except that either party may bring a claim in small claims court.

If we ever have a dispute, it'll be handled under Delaware law through arbitration — not a long court battle.

16. Changes to These Terms

We may update these Terms periodically. When we do, we'll post the new version on our website with an updated effective date. Continued use after changes means you accept the new terms.

We'll keep you informed when we update the Terms. If you keep using Kreator after that, it means you agree with the updates.
